A Seed IP litigation team led by partner E. Russell Tarleton just received an important victory for client Maverick Sports Medicine, Inc. d/b/a Pro-Tec Athletics in its defense of a patent infringement suit filed in North Carolina. After filing an inter partes Review (IPR) proceeding to challenge the validity of the plaintiff’s patent, Maverick moved for a stay of the District Court proceedings. The Judge granted Maverick’s motion to stay over vigorous opposition by the plaintiff, Implus, and entered the stay pending the outcome of the IPR. The win will significantly benefit Maverick by allowing it to focus solely on the IPR without the additional burden of expensive and potentially unnecessary concurrent district court litigation. Notably, Implus has asserted its patent for a hollow-core foam massage roller against more than a dozen companies, but Maverick is the only company that has challenged Implus’ claims.
